Terms of Service
Effective date: 30 October 2025
Overview
Legal entity: Investor Pilot Pty Ltd, ABN 96 101 887 272, registered address PO Box 2502 Graceville, Qld 4075 (“Investor Pilot”, “we”, “us”, “our”).
Acceptance
By creating an account, installing our PWA, or using any part of Investor Pilot (the “Service”), you agree to these Terms and our Privacy Policy and Cookie Policy. If you use the Service for a company, you confirm you are authorised to bind that company.
The Service
Investor Pilot provides tools to plan, track and analyse investments, plus alerts and educational content. We may add, change, or remove features at any time, including beta features which may be less stable.
No financial advice. Information, signals, alerts, models and projections are general information only and do not consider your objectives, financial situation or needs. Markets involve risk; you are responsible for your decisions.
Accounts and access
- Provide accurate information and keep your credentials secure.
- Do not share your login or use the Service in someone else’s name.
- You are responsible for all activity under your account.
- We may suspend or terminate accounts that breach these Terms.
Subscriptions, trials and billing
- Plans: Free, Essential Investor, Investor Plus, and Pro Trader (see Plans & Pricing).
- Billing: Paid plans are billed in advance on a recurring basis (monthly unless stated otherwise) and auto-renew until cancelled.
- Taxes: Prices may be shown inclusive or exclusive of taxes; applicable GST and other taxes will be added where required.
- Trials and promotions: If you start a trial, you will be charged at the end of the trial period unless you cancel before it ends.
- Plan changes: You can upgrade or downgrade at any time; changes apply immediately or at the next billing cycle as shown at checkout.
- Price changes: We may change fees with at least 30 days’ notice; changes apply to future billing periods.
- Refunds: Except where required by law, fees are non-refundable. If we materially fail to provide the Service and cannot fix it within a reasonable time, contact us and we will act fairly in line with Australian Consumer Law.
Acceptable use
You agree not to:
- Break the law or violate market-data terms;
- Infringe intellectual property rights;
- Access the Service in a way that could harm or overload our systems;
- Reverse engineer, copy, scrape or resell the Service;
- Upload malicious code or bypass security measures;
- Misuse non-public content or abuse rate limits or fair-use thresholds.
We may throttle or suspend accounts that abuse rate limits or fair-use thresholds.
Data, privacy and security
Your Data: You retain ownership of data you upload, import, or connect (for example, holdings and transactions). You grant us a licence to process it to run the Service, improve features, and provide support.
Privacy: We handle personal information in accordance with our Privacy Policy.
Security: We use reasonable technical and organisational measures to protect your data; no method is 100% secure.
Backups and retention: We maintain regular backups and retain data as needed to provide the Service and meet legal obligations. On termination, you can request deletion, subject to legal retention requirements.
Market data, third parties and integrations
Market data, prices, broker connections, and other integrations may be provided by third parties and are subject to their terms, availability, and delays or inaccuracies outside our control. We do not guarantee continuous access to third-party services and may change or discontinue integrations at any time. Links to third-party sites are not endorsements; use them at your own risk.
Availability and support
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will usually be scheduled to minimise disruption. Support is available via email; response times vary by plan and load.
Intellectual property
We own the Service (including software, designs, databases, models and branding), except for Your Data. You may not copy, reproduce or create derivative works from the Service. If you provide feedback or suggestions, you grant us a perpetual, worldwide, royalty-free licence to use that feedback.
Publicity
We may use your company name and logo in customer lists and marketing materials unless you opt out by emailing support@investorpilot.au.
Termination
- You may cancel your subscription at any time via the app; your plan runs until the end of the current billing period.
- We may suspend or terminate access if you breach these Terms, if the Service is discontinued, or for legal or security reasons.
- On termination, your licence to use the Service ends. We may retain data as required by law or for legitimate business purposes, such as audit logs and invoices.
Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available.” We make no warranties about fitness for a particular purpose, accuracy, availability, or non-infringement. You are responsible for verifying results before relying on them.
No financial advice: Nothing in the Service constitutes personal financial, legal, or tax advice. Consider your objectives, financial situation, and needs, and seek professional advice where appropriate. Past performance is not indicative of future results.
Limitation of liability
To the extent permitted by law:
- We exclude all liability for indirect, special, incidental, or consequential loss, including loss of profits, revenue, data, or business interruption.
- Our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid to us in the 12 months before the event giving rise to the claim, or AUD $100 for Free plan users, whichever is greater.
- Nothing in these Terms limits your rights under Australian Consumer Law, or our liability for fraud, wilful misconduct, or circumstances where liability cannot be excluded by law.
Indemnity
You agree to indemnify, defend, and hold harmless Investor Pilot Pty Ltd, its officers, directors, employees and agents against any claims, damages, losses, costs (including legal fees) arising from: (a) Your Data; (b) your breach of these Terms or applicable law; or (c) your misuse of the Service.
Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice, for example via email or an in-app notification. Continued use of the Service after the effective date of updated Terms means you accept the new Terms.
Consumer rights (Australia)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Beta features
Beta or early-access features are provided for evaluation purposes “as is.” They may change or be discontinued at any time without notice and may not be covered by standard support commitments or service level agreements.
PWA and device permissions
If you install our Progressive Web App (PWA) or enable notifications, we may store local data (such as cached content and preferences) on your device and send push notifications for alerts you have enabled. You can disable these at any time in your device or browser settings.
Confidentiality
Each party agrees to keep the other party’s non-public information confidential and to use it only for the purposes of providing or using the Service, except where disclosure is required by law or with the disclosing party’s prior written consent.
Governing law and disputes
These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland. Before commencing formal proceedings, each party will use reasonable efforts to resolve any dispute in good faith through direct negotiation.
Export and sanctions
You must comply with all applicable export control and trade sanctions laws and regulations. You may not use the Service if you are subject to sanctions administered by Australia, the United States, the United Nations, or any other applicable authority.
Entire agreement
These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and Investor Pilot Pty Ltd in relation to the Service and supersede all prior discussions, representations, and agreements relating to the same subject matter.
